Kenya Institute of Management Complies with Commission’s Orders, Releases Requested Information

The Chief Executive Officer (CEO) of the Kenya Institute of Management (KIM) has complied with orders issued by the Commission on 16th June 2025. The orders, issued pursuant to Section 23(2)(a) of the Access to Information Act 2016, required the CEO of KIM to facilitate access to information and records relating to a request made by a former employee contained in a letter dated 31st January 2025. The former employee had sought her duly filled Jubilee Insurance Occupational Scheme Withdrawal Form, executed by the designated scheme Trustees.

The former employee appealed to the Commission for review after the CEO of KIM failed to process her information request dated 31st January 2025 within the statutory timelines of twenty-one days. The Commission then took up the matter with the CEO, KIM, requesting an Institutional Report.

“The Commission notes that the statutory timelines to process the request for information under section 9(1) of the ATI Act have since lapsed. Therefore, the Commission requests your Institutional Report under Section 22(3) of the ATI Act within seven days to allow appropriate decision on the application. Kindly note that if no response is received from your Office within the indicated timeline, the Commission may proceed to make a decision, your response notwithstanding,” read the Commission's letter to the CEO.

The letter did not elicit a response, prompting the Commission to issue orders on 16th June 2025 pursuant to Sections 22(3)(a)(i) and Section 23(2)(a) of the Access to Information Act. These orders required the CEO to facilitate access to the information and records relating to the former employee's request (contained in the 31st January 2025 letter) within twenty-one days from the date of the order. The orders stipulated that failure to comply within this timeline would render the CEO liable to pay the Applicant the sum of Kenya Shillings Ten Thousand (Ksh.10,000/=) per day as compensation under Section 23(2)(b) of the Access to Information Act, until the information was released.
