Pension Arrears Paid After Two Years

A retired teacher finally received his pension arrears thanks to the Ombudsman in a case of inordinate delay by the Pensions Department. 

Mr. Sadi Henry complained to the Commission alleging delay by the Pensions Department to process and pay pension arrears arising from the Court of Appeal’s decision in Nakuru Civil Appeal No. 300 of 2009- TSC Vs Simon P. Kamau & 19 Others that ordered the review of terms of service for teachers who retired between July 1998 to June 2003. He stated that despite sending several letters to the department since 2021, the issue had not been addressed, prompting him to seek the Commission's assistance. 

The Commission by way of inquiry in July 2022 took up the matter with the Director Pensions and made subsequent follow-ups, leading to the processing and payment of the arrears. Mr. Sadi, in a communication to the Commission, acknowledged receipt of payment of Kshs. 374, 214.
