Information Corrected Following Ombudsman Intervention

A resident of Uasin Gicshu County finally got his piece of land registered following the correction of information under the Access to Information Law, 2016.

Mr. Joseph Muyeso appealed for review under the Access to Information Act, 2016 following the failure by the Uasin Gishu County Lands Office to correct information on land parcel within the outskirts of Eldoret Town. Mr. Muyeso alleged that he was the bonafide owner of land parcel in question having been declared the owner vide the ruling in Eldoret Court of Appeal in 2018. Following the ruling, he initiated the transfer process of the land parcel from Josiah Keimbur Kibias to his name. The land parcel had a charge registered which he duly settled and sought for the discharge of the same.

It came to his attention that the transfer and the discharge of the charge had not been effected therefore he lodged a request for the correction of information to confirm that he is the registered owner of the land parcel and that the same had no charge. The Lands Office failed to effect the correction despite the lapse of twenty-one days since the request was made pushing him to seek the intervention of the Commission under the access to information law.  

Following the Commission’s intervention through a letter dated 20th March 2023, the discharge was duly effected and Mr. Muyeso’s name was registered as the proprietor to the land parcel.
